Terms of Service of Flexys.ai

1. Definitions and applicability

These Terms apply to all services of Flexys.ai, an AI Business SaaS platform. By using the platform, you accept these terms.

2. Services

  • Web hosting and website builder with AI content generation
  • AI chat assistant for customer communication
  • AI voice agents for telephone support
  • Integrated CRM system for customer management
  • Invoicing and quotes with online payment links
  • Email campaigns and marketing tools
  • Automated workflows (n8n)
  • Customer portal for self-service
  • WhatsApp and SMS integration
  • Calendar management and online bookings

3. Account and access

  • You are responsible for your access credentials
  • You guarantee that registration information is accurate and up to date
  • You are responsible for all activities under your account

4. Fair use policy

  • AI Chat: maximum 20 messages per conversation, 50 message history
  • Voice calls: maximum 30 minutes per call
  • Messages: maximum 5,000 characters per message

5. Prohibited use and abuse

The following are strictly prohibited:

  • Spam, phishing or unsolicited messages
  • Illegal activities, fraud or deception
  • Misuse of AI or voice features for intimidation or deception
  • Generation of illegal content or content that infringes third-party rights
  • Resale of access without written permission
  • Attempts to circumvent platform security
  • Deliberate overloading (DDoS, API abuse)

Upon detection of abuse, Flexys.ai reserves the right to immediately remove accounts, websites and all associated data without prior notice. No refunds will be issued.

6. Intellectual property

  • Software: All IP rights belong to Flexys.ai
  • Customer content: Your content remains your property
  • AI content: Freely usable for commercial purposes

7. Pricing and payment

Flexys.ai offers one membership (Flexys.ai All-in-One) with all features included:

  • €29.95 per month or €287.40 per year (20% discount)
  • 14-day trial period with a one-time activation fee of €4.95
  • After the trial, the membership is automatically activated
  • $15 monthly API credit included (for AI, voice, chat and SMS)

Credit bundles (one-time top-up):

  • €15, €25 or €50 — added to your balance immediately
  • Credit bundles are non-refundable — purchased credit cannot be reclaimed or exchanged for money
  • Unused credit from bundles does not expire

All prices include VAT. Payment via Stripe (iDEAL, credit card, Bancontact). Access may be suspended in case of late payment.

8. Availability

Target: 99.5% uptime without guarantee of 100%. Maintenance announced with 24h notice.

9. Limitation of liability

  • Limited to membership fees of the last 12 months
  • No liability for indirect damages, loss of profit or data
  • No liability for accuracy of AI-generated content
  • No liability for data breaches resulting from unauthorized access to API keys or login credentials of external platforms (social media accounts, payment providers or other connected services)

The User is responsible for securely managing their access credentials and promptly reporting any suspected unauthorized use. When using the social media module, OAuth tokens are stored encrypted, but Flexys.ai cannot guarantee against security incidents at the external platforms themselves.

10. Data Breaches and Notification

  • In case of a suspected data breach, Flexys.ai will notify the affected customer within 48 hours.
  • Flexys.ai reports data breaches to the relevant Data Protection Authority within 72 hours, in accordance with the GDPR.
  • As a customer, you are the data controller for personal data of your end users. You must independently assess whether a breach requires notification to your end users or the DPA.
  • Flexys.ai provides reasonable cooperation in investigating and resolving data breaches.

11. API Keys and Integrations

  • You can connect your own API keys for third-party services (including OpenAI, Anthropic, Google, Stripe Connect, social media platforms).
  • You are fully responsible for managing, rotating, and securing API keys you have entered.
  • Flexys.ai stores API keys encrypted (AES-256-GCM) but is not liable for costs, misuse, or damages caused by compromised keys.
  • You must immediately revoke compromised keys with the relevant provider and configure a new key.

12. Confidentiality

Both parties commit to maintaining confidentiality of confidential information received from each other in the context of the agreement. This obligation continues after termination of the agreement.

13. Force Majeure

Flexys.ai is not liable for failure to meet obligations due to force majeure, including: disruptions at suppliers or service providers (including cloud providers, AI providers, and payment services), internet outages, power failures, cyberattacks, natural disasters, pandemics, government measures, or other circumstances beyond our reasonable control.

In case of force majeure lasting more than 30 days, you have the right to terminate the agreement free of charge.

14. Termination

  • By you: At any time. Data available for 30 days for export
  • By Flexys.ai: For violation of terms, abuse or non-payment
  • Data deleted within 30 days after termination

15. Changes

30 days' advance notice by email for material changes.

16. Applicable law

Dutch law. Competent court of Amsterdam.
